Promotional Sweepstakes Rebate Offer Terms and Conditions

1. Promotional Offer

This Sweepstakes Rebate Offer (hereinafter “Sweepstakes Offer”) allows eligible participants to enter for a chance to win a cash prize equal to the price of a qualifying purchase or lease made or obtained during the Promotional Period not to exceed $30,000.00. The “Promotional Period” shall be from April 1, 2023, through June 30, 2023. Qualifying purchasers who purchase any retail vehicle and who elect to participate in this Sweepstakes Offer will receive a chance to win a cash prize equal to the amount of a qualifying purchase made during the Promotional Period less taxes, title, fees, extended warranty plans, trade-in value, and any other promotional offers, rebates, or incentives. Qualifying lessees who lease a retail vehicle during the Promotional Period and who elect to participate in this Sweepstakes Offer will receive a chance to win a cash prize based on the purchase price of the vehicle at the time of the lease, less taxes, title, fees, and the residual value, and any other promotional offers, rebates, or incentives. Maximum prize amount is $30,000.00. Limit one (1) entry per vehicle.

This Sweepstakes Offer is valid only on qualifying retail vehicle purchases or leases made or obtained through Jeff Schmitt Auto Group (hereinafter “Jeff Schmitt”) at any of the following locations: Jeff Schmitt Cadillac 631 S. Orchard Lane, Beavercreek, Ohio 45434; Jeff Schmitt Chevrolet East, 635 S. Orchard Lane, Beavercreek, Ohio 45434; Jeff Schmitt Chevrolet North, 1001 N. Broad Street, Fairborn, Ohio 45324; Jeff Schmitt Chevrolet South, 125 S. 2. Eligibility

This Sweepstakes Offer is open to all individuals who are residents of the United States and who are eighteen (18) years of age or older as of the date of purchase or lease. Employees, the immediate family members (spouse, domestic partner, child, stepchild, grandchild, parent, stepparent, mother-in-law, father-in-law, son-in-law, daughter-in-law, brother, sister, half-brother, half-sister, grandparent) of any employee of Jeff Schmitt and its affiliates, and any household members of any such employee, are ineligible to participate. By electing to participate in the Sweepstakes Offer, participants agree and consent to all terms and conditions set forth herein.

3. Entry

Qualifying purchasers and lessees who make an eligible purchase or lease of any retail vehicle may elect to participate in the Sweepstakes Offer by completing a participation form and signing a copy of these Terms and Conditions at any of the following Jeff Schmitt Auto Group locations: Jeff Schmitt Cadillac 631 S. Orchard Lane, Beavercreek, Ohio 45434; Jeff Schmitt Chevrolet East, 635 S. Orchard Lane, Beavercreek, Ohio 45434; Jeff Schmitt Chevrolet North, 1001 N. Broad Street, Fairborn, Ohio 45324; Jeff Schmitt Chevrolet South, 125 S. Gebhart Church Road, Miamisburg, Ohio 45342; Jeff Schmitt Lawn & Motor Sports, 2292 Yellow Brick Road, Beavercreek, Ohio 45434; Jeff Schmitt Mazda, 646 Alpha Road (US 35), Beavercreek, Ohio 45434; Jeff Schmitt Mitsubishi, 1045 N. Central Avenue, Fairborn, Ohio 45324; Jeff Schmitt Nissan, 725 Alpha Road, Beavercreek, Ohio 45434. Limit one (1) entry per qualifying purchase or lease. Each Participant will be assigned an automatically-generated number. No entries will be accepted after the expiration of the Promotional Period on December 31, 2022.

4. Selection and Delivery

On the first day of the month following the close of the Promotional Period, a single winner will be randomly selected from the pool of automatically-generated numbers assigned to eligible participants. The odds of winning depend on the number of eligible participants received during the Promotional Period. One (1) prize is available in the amounts specified herein, not to exceed $30,000.00.

A winner will be chosen from the pool of automatically-generated numbers from each participation form received during the Promotional Period. The winner will be notified by the preferred contact method indicated on the participation form, including by telephone, regular U.S. mail, or email. Jeff Schmitt will make all reasonable efforts to notify the winner within the five (5) business days following the random selection. The selected winner must respond to the notification by contacting Jeff Schmitt by telephone at the number indicated or appearing in person at any Jeff Schmitt location during normal business hours. If, after such reasonable efforts are made to notify the selected winner, the selected winner fails to respond within forty-eight (48) hours after the last notification attempt made by Jeff Schmitt, the selected winner’s prize will be forfeited and an alternative winner will be randomly selected. All of the foregoing notification and response terms shall apply to the alternative winner. If, after reasonable efforts to notify the alternative winner, the alternative winner fails to respond in accordance with the foregoing, the alternative winner will forfeit the prize. Thereafter, in accordance with the foregoing terms, Jeff Schmitt will make one additional random selection of a potential winner. If the potential winner fails to come forward in compliance with these terms, the prize will be considered unclaimed and will not be disbursed.

Once a winner is notified and has come forward to claim the prize in accordance with the foregoing, the winner must accept the prize in person and as instructed by Jeff Schmitt. The prize will be disbursed by check made payable to the purchaser or lessee, or if jointly purchased or leased, in the joint names of the purchasers or lessees. The prize amount for a qualified purchase will be equal to the price of the winner’s qualified purchase made during the Promotional Period, less taxes, title, fees, extended warranty plans, trade-in value, documentation fees, accessories, finance and vehicle protection products, and any other promotional offers, rebates, or incentives. The prize amount for a qualified lease will be based on the purchase price of the vehicle at the time of the lease, less taxes, title, fees, extended warranty plans, residual value, documentation fees, accessories, finance and vehicle protection products, and any other promotional offers, rebates, or incentives. The prize amount will not exceed $30,000.00 under any circumstances. Limit one (1) entry per vehicle. No prize will be disbursed until all funds have cleared and the lienholder, if applicable, has fully funded the purchase.

The winner is required to complete an IRS Form W-9 at the time of acceptance to provide all required personal information, including full name, address, date of birth, and social security number. The winner is responsible for any applicable federal, state, and local taxes resulting from receipt of the prize. The winner may be required to complete additional documents necessary for disbursement of the prize in accordance with all applicable laws and regulations.

5. Conditions

By signing the participation form, the winner agrees and hereby gives consent to Jeff Schmitt and its affiliates to use of the winner’s likeness, including the winner’s first name and last initial, photograph, voice, recorded video footage, address (city and state only), and any statements, for marketing and other advertising or publicity purposes, without compensation, unless otherwise prohibited by law.

If the winner fails or refuses to sign and return all required documents as set forth herein, the winner may be disqualified and an alternative potential winner will be selected in accordance with Section IV. Jeff Schmitt reserves the right, in its sole discretion, to disqualify any participant who in any manner tampers with, or attempts to tamper with, the random-selection process or this Sweepstakes Offer. Jeff Schmitt is not responsible for any errors or illegible information contained in the participation forms or any errors or delays resulting from the actions or inactions of any participant or any third parties. Jeff Schmitt makes no warranties, express or implied, regarding this Sweepstakes Offer and hereby expressly disclaims the same. Jeff Schmitt reserves the right to cancel this Sweepstakes Offer at any time without notice.

6. General Provisions

The participant acknowledges that these Terms and Conditions constitute the final and complete agreement governing the Sweepstakes Offer. No other agreements or representations, oral or written, will be given effect. No modification, waiver, amendment, or change of these Terms and Conditions are valid absent the express written consent of Jeff Schmitt. If any provision in this Sweepstakes Offer is determined to be invalid or unenforceable, the enforceability of the remaining portions shall be unaffected and shall remain in full force and effect.

7. Governing Law

The construction and interpretation of the Sweepstakes Offer and the rights and obligations of any party in connection with the Sweepstakes Offer shall be governed by the laws of the state of Ohio.

As a participant, the undersigned does hereby agree that he or she has read and understands the foregoing Terms and Conditions and agrees to abide by said Terms and Conditions in order to participate in this Sweepstakes Offer.
